Wir wollen mit Ihnen juristische und theologische Methoden der Auslegung von Texten und der Fortbildung von Recht und Religion zueinander in Beziehung setzen und vergleichen. Studierende beider Fächer werden Kurzreferate (nicht länger als 15 Minuten) halten, an die sich jeweils eine fächerübergreifende Diskussion anschließen soll. Studierende der Rechtswissenschaft, die einen Seminarschein erwerben wollen, müssen zusätzlich eine Seminararbeit vorlegen. Die Studierenden der ev. Theologie sind von diesem Erfordernis nicht betroffen, sollten aber einen Kurzvortrag übernehmen, in dem sie das jeweilige Thema aus der Sicht ihrer Disziplin beleuchten.
Als Themen schlagen wir vor:
1. Was verstehen Juristen und Theologen unter „Methoden“?
2. Gibt es ein für Gerichte verbindliches Methodenrecht? Gibt es verbindliche Auslegungsregeln für den Exegeten, den Religionslehrer oder den Prediger?
3. Welche Rechtsnatur hat Methodenrecht? Beschränken das kirchliche Dienst- und Arbeitsrecht die Rede- und Meinungsfreiheit von Theologen?
4. Rechtsvergleichung und Religionsvergleichung: Um welche Erkenntnisziele geht es jeweils?
5. Kommunikationsprozesse zwischen Gesetzgeber und Rechtsanwender und zwischen den Verfassern religiöser Texte und ihren Interpreten
6. Quellen des Rechts und Quellen der Religion: Wie unterscheidet am zwischen Recht und Nicht-Recht? Und wie unterscheidet man zwischen religiösen und weltlichen Aussagen?
7. Rechtsetzung durch Richter? Religionsfortschreibung durch Prediger? Theologisierung des Rechts?
8. Juristische Falllösungsmethoden. Methodische Grenzen politischer Aussagen von Theologen
9. Auslegung nach dem Wortsinn: Grund, Grenzen, und die Bewältigung von Mehrdeutigkeit
10. Nichtanwendung von ihrem Wortlaut nach einschlägigen Regeln des modernen und des biblischen Rechts
11. Anwendung von ihrem Wortlaut nach nicht einschlägigen Regeln des modernen und des biblischen Rechts, insbesondere im Wege der Analogie
12. Verfassungskonforme Auslegung, oder: Neues Testament verdrängt altes?
Termin für eine Vorbesprechung am 04.10.2023 um 18.00 Uhr im Raum E04 des European Legal Studies Institute (Gebäude 44, Süsterstr. 28, Erdgeschoss). Eine weitere Vorbesprechung findet statt am 18.10.2023 in Raum 44/E04 um 18.00 Uhr. Die Seminarsitzungen finden wöchentlich mittwochs von 18-20h statt. Beginn am 25.10.2023.
